MFC Camp Event Terms & Conditions
ORGANIZER
The organizer of the Event is Justyna Traczyk conducting business activity under the name "for the better Justyna Traczyk" in Warsaw, 37 Adama Mickiewicza Street, 53, 01-625 Warsaw, registered in the Central Register of Business Activity and Information, holding NIP no.: 5791979973, REGON no.: 220851153 ("Organizer").
DEFINITIONS
The following terms used in the Terms and Conditions have the following meanings:
Minor - means a person under the age of 18;
Legal Representative - means the parent or legal guardian of an individual (i.e., Participant) with limited legal capacity, as well as the parent or legal guardian of a Minor, partially incapacitated or totally incapacitated;
RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation);
Terms and Conditions- means these Terms and Conditions of the MFC Camp event;
Participant - means any natural person who has paid participation for access to the Classes, and thus has accepted these Terms and Conditions and made the statements, commitments and assurances described herein, and thus has the right to participate in the Classes, regardless of whether this right (and opportunity) will be exercised. A Minor may be a Participant, but on the condition that he/she remains under the supervision of an adult during the Classes, in accordance with paragraph 5.8. of these Terms and Conditions, while obtaining prior consent for such participation from the Legal Representative. Whenever the Terms and Conditions refer to a Participant, it shall also mean a Minor with his/her Legal Representative;
Agreement - an agreement between the Participant and the Organizer, concluded at the moment referred to in item. 4.2. of the Terms and Conditions.
Event - means the event named Movement For Change Camp"MFC Camp", organized by the Organizer;
Classes - means yoga and Pilates workshops held on the premises and other accompanying events. The Organizer reserves the right to modify the order of individual events - or minor changes in the length of their duration caused by the dynamics of the event, e.g. the possibility to take pictures with as many Participants as possible or discussions regarding the lectures held. These changes will not affect the essence of the plan presented above - the Organizer will keep the Participants informed of any changes through email communication or through social media dedicated to the event.
GENERAL PROVISIONS
These Terms and Conditions set forth the terms and conditions, application procedure and rules for participation in the Event. Participation in the Event is tantamount to acceptance by the Participant of the provisions of the Regulations.
The subject of the Agreement is the provision of the MFC Camp service by the Organizer to the Participant in accordance with the program indicated on the website www.movementforchange.pl (hereinafter referred to as the "Program") and the provisions contained hereinafter in the Terms and Conditions.
The participant declares that he/she has read, understands and agrees with the content of these Terms and Conditions and has familiarized himself/herself with the Program of the MFC Camp event organized on August 6, 2024. - August 10 2025.
The Event shall be organized at the start and end dates and locations indicated in the Program, which is available on the website www.movementforchange.pl and is attached to the contract. A detailed program of the Event and additional organizational information will be sent to the Participant at the e-mail address provided by the Participant, within 7 days before the commencement of the Event.
The organizer may, at its discretion, change or expand the program to include additional activities, workshops and meals, as well as select venues for activities not listed in the program.
The Organizer reserves the right to cancel the Event for reasons beyond its control (force majeure, decisions of state authorities), as well as as as a result of too low a turnout or weather conditions making it impossible to hold the Event, without incurring additional costs. In the event of cancellation of an Event, the Participant will be notified by phone, email or text message no later than the day before the start of the Event. In case of cancellation of the Event, the Participant is entitled to a refund of the entire price paid.
TERMS AND CONDITIONS FOR PARTICIPATION
Participation in the Event is conditional on payment of the required amount by the specified date to the account provided by the Organizer and signing a statement of acceptance of the Terms and Conditions.
The agreement shall be deemed concluded when the Organizer receives the required amount.
The Organizer does not provide transportation to the Event and return transportation.
In case of a limited number of places for the Event, the order of payment is binding for the Organizer.
In case of resignation of the Participant, the amount paid is refundable in accordance with the Law of May 30, 2014 on Consumer Rights, if the Participant withdraws from the contract within 14 days from the date of its conclusion. The cancellation can be made by sending an email, from the address provided by the Participant at registration, to the email address: hello@movementforchange.pl . In the body of the message, details of the order should be provided. Funds will then be returned to the Participant to the bank account number from which participation in the Event was paid.
The course of the Event will be reported by means of photos and audio video recordings, which may capture the image of the Event Participants.
Pursuant to Article 81.2.2 of the Act of February 4, 1994 on Copyright and Related Rights, permission is not required to distribute the image of a person who is only a detail of a whole, such as a gathering or public event. However, if the Event Participant completely does not agree with any recording of his/her image, even indirectly, in the coverage of the Event, the Organizer asks to inform the Organizer in advance via e-mail: hello@movementforchange.pl The Organizer will endeavor to ensure that the Participant's person is omitted by photographers and videographers when creating coverage of the Event.
The Participant is aware of the recording of the course of the Event (e.g. in the form of photographs, audio-visual film, etc.), including in particular the Participant's image, for the purposes of documentation and promotion or advertising of the Event and Events in future years, for commercial and non-commercial purposes of the Organizer. Participation may involve recording and disseminating photographs or recordings by any technique, and marketing the work with the Participant's image, including, in particular, through lending or leasing, disposal free of charge or against payment, dissemination of the work with the Participant's image in any way, including, but not limited to public performance, exhibition, display, reproduction, as well as broadcasting and re-broadcasting, as well as making the work available to the public in such a way that everyone can have access to it at a place and time of their own choosing, and all this both in terms of the work with the Participant's image and the copies on which this image was recorded, and to reproduce the image with all currently available techniques and methods, dissemination and publication, including with images of other persons recorded within the material (its entirety or parts), without payment to the Participant of any fees. At the same time, the Participant, waives all rights related to the control and approval of each use of the Participant's image, including in the case of using it for the purpose of combining it with other images through digital techniques. The Participant also declares that the use of the image in accordance with this consent does not violate anyone's personal rights or other rights. The participant further declares that this consent is also binding for heirs and successors in title. The participant declares that this consent is irrevocable, valid worldwide and unlimited in time, and subject to the laws of Poland. The Participant, represents and warrants that he/she has full legal capacity to grant this consent. The participant declares that he/she grants this consent without the right to additional payment, and at the same time he/she declares that he/she waives all rights to remuneration for the publication of the aforementioned image, and at the same time he/she expresses unconditional and irrevocable consent, and at the same time without the right to additional payment, to benefit from the use of the aforementioned image.
Additionally, the Participant will be required to sign a separate consent form for the use of their likeness upon on-site registration at the Event.
PARTICIPANT'S STATEMENTS AND RESPONSIBILITIES
Each person who pays for participation in the Event and each Participant of this Event additionally declares that by accepting these Terms and Conditions he/she simultaneously declares and assures that he/she has no contraindications to exercise and participates in the Activity at his/her own risk, and also declares and assures that he/she will abide by the provisions of these Terms and Conditions.
In the case of Statutory Representatives who have paid for the participation of Minors, these Representatives, by accepting these Terms and Conditions, at the same time declare and assure that there are no contraindications to the exercise of the Minors and they participate in the Activities at their own risk, and also declare and assure that both they, i.e. Statutory Representatives, and the Minors will comply with the provisions of these Terms and Conditions.
By accepting these Terms and Conditions, the Participant declares that his/her health condition allows participation in the Event and confirms that there are no health contraindications to participation in the physical activities provided for in the Program. Participation in the various services available as part of the Event is voluntary and the Participant will participate in them at his/her own risk.
The participant undertakes to obey the instructions of the teaching staff, general safety rules and the rules of the facility.
During the course of the Event, the Participant shall abide by the rules and regulations of any facility within which the Event will be held, in particular the rules and regulations of the resort where the Participant will be staying.
In case of non-compliance with the regulations referred to in item. 5.5. of the Terms and Conditions, as well as in a situation where the Participant, by his/her behavior, will cause danger to persons or property, as well as other behavior impeding the proper course of the trip, the Organizer shall be entitled to terminate this agreement with immediate effect, without the possibility of refunding the fee for unused services.
The Participant is obliged to cover damages caused by himself and persons for whom he is responsible to the property and person of the Organizer, other Participants and third parties - including the owner of the facility where the Event takes place.
During the duration of the event, i.e. from August 6 - August 10, 2025, alcohol consumption is strictly prohibited.
If the Participant is a Minor, he/she may participate in the Event only under the care (i.e. "under the eye") of an adult, i.e. his/her Legal Representative. In order to dispel any doubts, it is considered that acceptance of these Terms and Conditions constitutes confirmation by the Legal Representative that he/she will exercise the aforementioned care over the minor during the Event.
The Organizer has the right to discontinue the Classes or has the right to change the content of the Classes, to restrict access to the Classes, in particular in a situation where the participating persons engage in inappropriate behavior, illegal behavior, behavior contrary to good manners or principles of social coexistence, and behavior contrary to the principles described in these Terms and Conditions.
Each Participant is responsible for his/her own safety and health. The Organizer provides NNW insurance, however, the Participant of the Event should also have individual health insurance. Climbing participants are required to purchase additional NNW insurance at their own expense.
OBLIGATIONS OF THE ORGANIZER, COMPLAINTS
If, due to the Organizer's fault, certain services are not provided, the Organizer assumes appropriate responsibility and is obliged to refund part of the payment for the service. The price of the Event may be reduced in due proportion to what conditions were guaranteed.
The basis for return is a complaint. The complaint should be submitted to the Organizer in writing to the address of the registered office. The Organizer will respond to the complaint in writing, within 30 days from the date of receipt of the complaint. If the Participant does not receive a response within the aforementioned period, the Organizer is deemed to have acknowledged the complaint as justified. In justified cases, this period may be extended, of which the Participant will be informed in writing. However, the basis of the complaint cannot be events and circumstances for which the Organizer is not responsible and, with due care, could not foresee them (e.g., acts of administrative authorities, weather conditions, force majeure).
After accepting the complaint referred to in sec. 6.1. and 6.2. of the Terms and Conditions, the money will be returned to the Participant to the bank account number from which the participation in the Event was paid.
The Organizer shall not be liable for any personal injury to the Participant, which occurred through no fault of the Participant, including, in particular, those resulting from improper exercise or exercise to the extent that the Participant's health condition does not allow it in a safe manner.
CONDITIONS AND CANCELLATION COSTS
The Client is entitled to terminate the agreement concerning participation in the Event at any time prior to its commencement, provided that written notice is furnished to the Organizer. The effective date of termination shall be deemed the date on which the Organizer receives the Client’s written declaration of termination.
Cancellation Fees
In the event of termination by the Client, the Organizer is entitled to demand a reasonable and justified cancellation fee, the amount of which shall be determined based on the time remaining until the commencement of the Event, anticipated cost savings, and any expected revenue derived from the alternative utilization of the relevant tourism services. The cancellation fee shall be assessed as follows:
15% of the total Event price for termination occurring 45 days or more prior to the scheduled commencement date of the Event.
35% of the total Event price for termination occurring between 44 and 31 days prior to the scheduled commencement date of the Event.
60% of the total Event price for termination occurring between 30 and 22 days prior to the scheduled commencement date of the Event.
80% of the total Event price for termination occurring between 21 and 15 days prior to the scheduled commencement date of the Event.
100% of the total Event price for termination occurring less than 14 days prior to the scheduled commencement date of the Event.
The aforementioned cancellation fee rates are established in accordance with Article 47, Sections 2 and 3 of the Act on Tourist Events and Related Tourism Services.
The Organizer shall process the refund of payments remitted by the Client, subject to deduction of the applicable cancellation fee, within 14 days from the date of receipt of the termination notice. The refund shall be issued to the bank account designated by the Client.
Termination Without Cancellation Fees
The Client shall have the right to terminate the agreement without incurring any cancellation fees in the event that unavoidable and extraordinary circumstances arise at the destination or in its immediate vicinity, materially affecting the execution of the Event or the transportation of Clients to the designated location. In such instances, the Client shall be entitled to a full refund of payments made in connection with the Event, without the right to any additional compensation, indemnification, or damages, in accordance with Article 47, Section 4 of the Act on Tourist Events and Related Tourism Services.
Form and Delivery of Termination Notice: The termination notice must be submitted in writing and duly delivered to the Organizer either in person, by postal mail, or via electronic means to the address specified in the agreement.
Immediate Enforceability of Administrative Fees
All administrative fees associated with cancellation and contract modifications, as well as fees for customized Event arrangements, shall become immediately due and payable upon the effective termination of the agreement.
PERSONAL DATA
The administrator of the Participant's personal data processed in connection with the Event ("Personal Data") is the Organizer, i.e. Justyna Traczyk, conducting business activity under the name "for the better Justyna Traczyk" in Warsaw, 37 Adama Mickiewicza Street, 53, 01-625 Warsaw, registered in the Central Register and Information on Business Activity, holding NIP No.: 5791979973, REGON No.: 220851153.
The Participant's Personal Data is processed:
For the purpose of entering into and executing the Agreement (Article 6(1)(b) of the RODO);
in order to fulfill the Organizer's legal obligations under the law (Article 6.1.c of the DPA);
for purposes arising from the legitimate interests pursued by the Organizer, such as ensuring security, establishing and asserting claims, defending against claims, internal administrative purposes, maintaining relations with the Participant (Article 6(1)(f) RODO);
based on the Participant's consent, for other purposes related to the execution of the Agreement (Article 6(1)(a) RODO).
The Participant's Personal Data will be processed for the period necessary for the purposes for which the Personal Data was collected and for which it is processed, i.e. for the execution of the concluded Agreement. After the expiration of this period, the Organizer will keep the Personal Data to the extent necessary for the time resulting from the applicable legal requirements. In justified cases, Personal Data may be kept as long as necessary for the realization of the Organizer's legitimate interests, such as the investigation of claims or defense against claims. If the basis for the processing of Personal Data is consent, the Personal Data will be stored until the purpose to which it pertained is completed, but no longer than until the consent is withdrawn.
The Organizer may transfer the Participant's Personal Data:
To entities entitled to receive them under the law;
entities processing Personal Data on behalf of the Organizer, e.g. companies (subcontractors) providing certain services to the Organizer, the performance of which involves the processing of Personal Data.
In each case of sharing or entrusting the processing of Personal Data, the Organizer undertakes to ensure that only the minimum information necessary to fulfill the purposes of the processing is provided.
Personal Data will not be transferred outside the European Economic Area ("EEA"). In the event that Personal Data were to be transferred outside the EEA, the Organizer will ensure that cooperation with such entities is based on an appropriate legal basis and that they provide appropriate standards of protection.
In connection with the processing of Personal Data, the Participant has the right:
access to the content of your Personal Data and obtain a copy of it;
Correct your Personal Data if it is incorrect or incomplete;
object to the processing of your Personal Data;
deletion of your Personal Data;
Limit the processing of your Personal Data;
transfer of your Personal Data;
revoke consent to the processing of Personal Data to the extent that it has been granted, at any time without affecting the legality of the processing performed on the basis of consent before its revocation;
lodge a complaint with the President of the Office for Personal Data Protection, in the event that the Organizer's processing of Personal Data is deemed to violate the provisions of the RODO.
Provision of Personal Data by the Participant is voluntary, but is a necessary condition for the conclusion and execution of the Agreement. Where the basis for the processing of Personal Data is the Participant's consent, the provision of Personal Data is voluntary, and failure to do so will result in the inability to fulfill the purpose for which the Data is collected.
Participant's Personal Data will not be profiled.
In matters related to the processing of Personal Data, the Participant may contact the Organizer at the data indicated in paragraph 9.5. of the Terms and Conditions.
FINAL PROVISIONS
These Terms and Conditions have been drawn up in the Polish language. The Polish language version is the exclusive basis for the interpretation of the provisions of the Agreement concluded between the Participant and the Organizer.
Correspondence, including all notices, information and other communications will be provided to the Participant in Polish, unless otherwise agreed by the parties.
The use of any additional services provided by the Organizer or cooperating external entities, not included in the scope of services specified in the Program, takes place on the terms and conditions individually agreed between the Organizer and the Participant.
In matters not regulated by these Terms and Conditions, the provisions of generally applicable law, in particular the Civil Code, shall apply.
Except as otherwise provided in the Terms and Conditions, the Participant may communicate with the Organizer in the form of:

In writing, at the address: Justyna Traczyk, 37 Adama Mickiewicza St. 53, 01-625 Warsaw.
The Organizer communicates with the Participant electronically, by telephone or in writing, to the data indicated by the Participant, unless otherwise specified in the Terms and Conditions.
The Participant shall not have the right to transfer the rights and obligations related to the performance of the Agreement, in whole or in part, to third parties without the prior consent of the Organizer expressed in at least documentary form. The existing Participant shall be jointly and severally liable with the new Participant for payment of all dues related to the Event until the date of transfer of rights and obligations related to the Agreement.
Declaring individual provisions of the Terms and Conditions invalid or ineffective as provided by law shall not affect the validity or effectiveness of the remaining provisions of the Terms and Conditions. The invalid provision will be replaced by the rule that comes closest to the purposes of the invalid provision and the Terms and Conditions as a whole.
The governing law for contractual relations between the Participant and the Organizer is Polish law.
